Limited Warranty

Due to the fluid nature of WordPress and the frequent updates associated with the platform and plugins, the website we develop and build that is INITIALLY approved by you is guaranteed to work as requested by you the site owner.

The warranty is VOID when:

1. YOU or any appointed agent you hire makes any changes to the site in any capacity.
2. It is updated to a newer version of the platform.
3. The programming and plugins are updated.
4. The hosting server where your website resides updates it’s programming.

ALL OF WHICH VOID ANY GUARANTEES the site will work as originally programmed.

ACA Web Consulting does not warrant that the functions contained in your web pages, the Internet web site or the operation of the web pages will be uninterrupted or error-free due to hosting issues, internet issues, domain name server issues or a myriad of other services that are beyond the control of ACA Web Consulting. The entire risk as to the quality and performance of the web pages and the website is with the client. In no event will ACA Web Consulting be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate these web pages or website, even if ACA Web Consulting has been advised of the possibility of such damages. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Copyrights and Trademarks.

The client represents to ACA Web Consulting and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to ACA Web Consulting for inclusion in web pages are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend ACA Web Consulting and its subcontractors from any claim or suit arising from the use of such elements furnished by the client.

Copyright to Web pages.

All original web templates, graphic images, photographs, text, and content provided to ACA Web Consulting by the client remain the sole exclusive property of the client.

Rights to photos, graphics, design/layout, source code, work-up files, and computer programs provided by ACA Web Consulting are specifically not transferred to the client and remain the intellectual property of ACA Web Consulting.   When the final payment for your website project is made, ACA Web Consulting transfers rights TO USE the website programming and files to the client. The intellectual property of the website programming, coding integration, SEO and layout are the permanent intellectural property of ACA Web Consulting.

When 3rd party programming (ie: theme, plugins, etc) is necessary to the functioning of the site, the site owner is responsible for the purchase of these third-party fees.

ACA Web Consulting reserves the right to display graphics and other Web design elements as examples of work produced in our portfolio.

Premium Plugins & Themes

ACA Web Consulting covers the cost of licenses for plug-ins, professional WordPress builders, and premium plug-ins during the first year of your project’s development. This means you get access to high-quality tools right from the start, no extra fees upfront. After that first year, it’s up to you to purchase and maintain those licenses to keep everything running smoothly with updates and support. Our goal is to kickstart your website with the best resources while giving you the reins to manage ongoing costs.

Sole Agreement.

When you agree to the formal proposal sent by ACA Web Consulting and you make an initial payment, this constitutes the sole agreement between ACA Web Consulting and the client regarding your website. All prices specified in the contract as dictated within the Web Development Proposal will be honored for six (6) months after the client make the initial payment for services.

Credit Line(s). The Developer shall receive credit notice in this form: “WordPress Web Design by www.acawebconsulting.com” or “Website Design by ACA Web Consulting” (with a link to www.acawebconsulting.com).

Right of Refusal

ACA Web Consulting reserves the right to terminate at their discretion a working relationship with a client at any time. Any fees paid will be immediately reimbursed for work that has not yet been done.
